SPECIAL NEEDS PLANNING AND TRUSTS

Special Needs Trusts (SNTs) may be used to transfer assets to improve the quality of life of an elder or special needs child without disqualifying him or her from public benefits such as SSI or MassHealth.

A SNT may be created as part of comprehensive estate planning for a family member with special needs, or to minimize the loss of public benefits when a person with special needs receives an inheritance or a personal injury settlement or award.  

Comprehensive planning is critical if you have a special needs child, not only to protect the assets for that child's future security and to maximize his or her potential, but to leave thoughtful instructions for those who will care for your child if any thing happens to you - instructiong regarding your hopes and dreams for your child, his or her likes and dislikes, your goals for his or her future, goals and plans to maximize his or her potential and foster independence.
